Overview
Josh is a zealous advocate for his clients as part of his detail-driven-and-merits-oriented legal practice. Josh spent the first three years of his practice as an associate at one of the largest private law firms operating in the State of Michigan, which had an international presence in supply chain litigation during Josh’s tenure. There, Josh represented publicly traded corporations and was primarily responsible for formulating winning litigation and other legal strategies in connection with complex commercial disputes. Josh has extensive experience practicing in Michigan State and Federal courts, including, without limitation, in various international disputes. From this experience, Josh has successfully navigated disputes or projects involving supply chain, Michigan State and Federal trademark infringement and unfair competition, trademark cancellation proceedings before the Trademark Trial and Appeal Board, the enforcement of valid trademarks in certain serial numbers, the Michigan Consumer Protection Act, copyright infringement, patent infringement, intellectual property chain of ownership, Digital Millennium Copyright Act takedown notices, injunctive relief, indemnity, mergers and acquisitions, automotive tooling, automotive just-in-time supply, bankruptcy, collections and lien law, fraudulent and voidable transfers, successor liability, piercing the corporate veil and alter egos, business defamation, civil rights, the Hague Convention on Service, the Hague Convention on Evidence, international civil and criminal liability exposures, alternative dispute resolution, the Federal Arbitration Act, business valuations, damages calculations, common law and statutory conversion, default judgments, tortious interference, intentional fraud, fraudulent omissions, the “battle of the forms” in connection with commercial sales, unconscionability of contractual enforcement, impossibility and impracticability of contractual performance, frustration of contractual purpose, adequate assurances of contractual performance, contract interpretation, contract assignment and delegation, third-party beneficiary enforcement of contractual rights, breach of representations and warranties, the constitutionality of agreements to consent to jurisdiction and venue, shareholder oppression, service of process, franchise law, tax law, the Michigan Sales Representative Commissions Act, the sales commissions laws of other states, commercial drone use, probate law, premises liability, product warranty, asbestos exposure, constructive notice for the purposes of the statute of limitations in asbestos litigation, administrative agency statutory interpretation, the United States of America Inflation Reduction Act, the United States of America False Claims Act, personal jurisdiction, discovery, the natural flow of surface water, government contracting, lay and expert witness opinions, cannabis licensing and land use, cannabis retailers, credit and debit card processing networks, virtual automatic teller machine services, short-term rental properties, civil and criminal contempt in Michigan, the Michigan CROWN Act, and more.
During and before law school, Josh served in various roles at the Michigan State Legislature under now-Senate Majority Leader Winnie Brinks (SD-29, Grand Rapids/Kentwood), then-State Representative Jon Hoadley (HD-60, Kalamazoo/Portage), and then-State Representative Vanessa Guerra (HD-95, Saginaw/Buena Vista). As the Office of Senator Winnie Brinks’s Legislative Director, Josh facilitated the introduction of various pieces of legislation that eventually were signed into law, including, without limitation, a bill to repeal a 1931 law criminalizing certain abortion procedures and did so immediately upon the continued existence of Roe v. Wade, 410 U.S. 113 (1973) being called into question. Further, in 2018, Josh, through his participation in the Michigan Legislature’s Progressive Women’s Caucus, championed an effort to organize a petition drive to enshrine 14th Amendment rights of abortion access under Roe into the Michigan State Constitution.
While studying law at Michigan State University, as well as during his time studying law while taking certain courses offered by Saginaw Valley State University, Josh received numerous awards for his academic excellence and legal prowess, including, without limitation, various awards from his participation in national and regional Moot Court competitions. Graduating summa cum laude at both Michigan State University and Saginaw Valley State University, Josh consistently earned degrees while ranked at the very top of his class. At Michigan State University, Josh graduated 9th in his class despite working part time almost the entirety of his three years in law school. And, upon passing the Michigan State Bar Exam, which, at the time, was consider as one of the most difficult Bar exams in the Nation, Josh received a score that placed him comfortably within the top 5% of his cohort. Josh’s pattern of consistent and continued excellence has followed him in his legal practice; he has never lost a case and has no plans to do so any time soon.
